ByteShop Module Terms
Special terms for the modules of the ByteShop solution. They supplement the HumanByte Terms and Conditions.
Scope and Order of Precedence
1.1 These Module Terms apply when a customer ("Customer") orders ByteShop or one of its modules from HumanByte GmbH ("HumanByte"). They supplement the HumanByte Terms and Conditions. If the two conflict, these Module Terms prevail for the ordered modules.
1.2 The Customer orders only the modules listed in the signed order or accepted quote. The terms of a module apply only if that module is ordered.
The Modules
ByteShop is made up of the following modules:
- Access: ByteGate door controllers and the ByteKey app, with a personal QR code and a login code sent by SMS.
- Self-checkout and point of sale: the connection between the Customer's checkout and the access and reporting functions.
- Cameras and Sentinel: cameras and local recording and, if the Customer orders it, the Sentinel night check with its morning report.
- Dashboard and reports: the ByteGate dashboard with access logs and reports.
Roles
3.1 The Customer runs its own store. The Customer, not HumanByte, enters into the sales contracts with its shoppers and decides on prices, products, opening hours, and access rules.
3.2 HumanByte supplies technology and services. HumanByte does not operate the store and is not a party to the contract between the Customer and its shoppers.
3.3 For ByteShop, HumanByte works with biolini GmbH (Bioflix), which operates self-service stores of its own. biolini GmbH may take part in advice, onboarding, and training. HumanByte is the Customer's contracting party and is responsible to the Customer for the Services.
Access Module
4.1 HumanByte supplies and configures the access technology as ordered. The Customer decides who may enter, at what times, and when access is withdrawn.
4.2 HumanByte suspends or restores access technology on the Customer's instruction. HumanByte is not responsible for a decision of the Customer to refuse or withdraw access.
4.3 A QR code or login code is personal. The Customer must tell its shoppers in its own terms that credentials may not be shared and that access may be withdrawn if they are misused.
Self-Checkout and Point of Sale Module
5.1 The Customer is responsible for prices, value added tax, receipts, refunds, and the payment methods it accepts. The self-checkout works with the payment services of Worldline. The Customer concludes the agreement for accepting payments with Worldline or with another provider it chooses, and the terms of that provider apply. HumanByte does not hold the Customer's funds.
5.2 HumanByte is not responsible for outages or errors of Worldline or of other payment providers or third-party checkout systems.
5.3 The Customer must tell its shoppers in its own terms how self-checkout works, that they must scan all items, and that checks may be carried out.
Cameras and Sentinel Module
6.1 HumanByte installs and configures cameras and recording as agreed in the order and the camera plan. The Customer decides on the purpose, the placement, and the retention period. Unless the Customer instructs a shorter period, recordings are kept for 5 days and then overwritten automatically.
6.2 The Customer is the controller of the recordings. It must keep recordings only as long as necessary for its purpose, protect them from unauthorized access, and delete them afterwards. It must not record public space or areas where privacy is particularly protected.
6.3 The Customer must put up clearly visible notices at the entrance and must inform its shoppers about the cameras and the retention period in its privacy notice.
6.4 If the Customer orders Sentinel, it is an automated aid. It flags unusual events, such as an entry without a matching purchase, and prepares a morning report. A flag is an indication, not proof. The Customer must check each flag before it acts against any person, and it alone decides on follow-up, on reports to the police, and on any charges.
6.5 Where recordings are stored on the Customer's premises, HumanByte accesses them only if and as far as the Customer instructs it to for support purposes.
Shopper Accounts and Messages
7.1 The Customer is the controller of its shoppers' personal data. HumanByte processes this data on the Customer's behalf under the data processing agreement referred to in the Terms and Conditions.
7.2 Login codes are sent by SMS through third-party providers. HumanByte has no influence on the delivery or the speed of SMS messages. Login codes sent by SMS are included in the price. HumanByte may limit or block abnormal use, such as automated or fraudulent requests for codes.
The Customer's Own Shopper Terms and Privacy Notice
8.1 The Customer must give its shoppers its own terms and its own privacy notice. They should cover registration and age or legal capacity requirements, access rules, payment and prices, cameras and retention, how misuse and theft are handled, liability, and governing law.
8.2 HumanByte may provide a template for these documents. A template is a starting point, is provided without warranty, and is not legal advice. The Customer must check and adapt it and is responsible for its own shopper terms. Any charge the Customer applies to shoppers, such as a flat fee for theft, is the Customer's decision and risk.
Availability
ByteGate controllers keep working offline and synchronize when the connection returns. Recordings are stored locally. Reports and cloud functions depend on the connection. No availability is guaranteed unless a service level is agreed in writing.
Compliance of the Customer's Store
The Customer is responsible for complying with the laws that apply to its store and its products, such as rules on opening hours, age-restricted goods, hygiene, and pricing. HumanByte does not check this.
